TERMS & CONDITIONS

HOME TAKAFUL POLICY

SECTION 1 – BUILDINGS

IN CASE THE PARTICIPANT OWNS AND OCCUPIES THE BUILDING

According to the Application submitted by the Participant and in consideration of the payment of the contribution mentioned in the Schedule by the participant or on his behalf, TAKAFUL INTERNATIONAL COMPANY B.S.C., (hereinafter called the Company) hereby undertakes to insure against loss, damage, liability or expenses subject to the conditions of this policy and any added terms provided hereunder in the Policy Schedule.

 

The Proposal and Declaration completed by the Participant shall form the basis of the contract and shall be incorporated in this Policy and together with the Schedule and Specification shall be all read together as one contract . The Company will indemnify the Participant in accordance with the Section specified in the Schedule by payment or at its discretion by repair or replacement and subject to the terms of this Policy.

 

 

SECTION 1 – BUILDING

1 A – Residence

Loss of or damage to the Building of the Residence (while for the purposes of this Policy shall mean a dwelling house including garages, outbuildings, landlord’s fixtures and fittings, walls, gates and fences) caused by the Perils specified below:

Perils  

  1. Fire, lightning and explosion of domestic vessels only (Fire, excluding self-fermentation and scorching)
  2. Storm (Violent and destructing movement of wind)
  3. Escape of Water (Escape of water from and including damage to fixed tanks, apparatus or pipes)
  4. Burglary (Only if accompanied by violent or forcible entry or exit from the premises)
  5. Impact (Impact by aircraft, aerial devices or articles dropped from them and vehicles not belonging to the participant or his/her family or under his/her control.)

Exceptions to Section 1A

a) Loss or damage arising under Perils (3) ‘Escape of Water’ and (4) ‘Burglary’, when the Residence has been left unoccupied for a period in excess of 30 days in any Period of Takaful.

b) Under Peril (2) ‘Storm’

(i) loss of or damage to gates and fences.

(ii) loss or damage by frost, subsidence or landslip.

c) Loss or damage arising under Peril (4) ‘Burglary ‘.

  (i) caused by deception

(ii) not involving forcible and violent entry to or exit from the Residence

d) Damage arising under Peril (5) ‘Impact’ caused by

(i) falling or lopping of trees by or on behalf of the participant

(ii) falling trees or branches to gates or fences .

 

1B – Glass and Sanitary Fixtures

The Company will indemnify the participant against accidental breakage of fixed glass forming part of the structure, and sanitary fixtures.

Exception to Section 1B

Breakage when the Residence is unoccupied.

 

1C- Miscellaneous Property

The Company will indemnify the participant, as provided in Section 1A, for loss of or damage to paths, drives, terraces, patios, and swimming pools, for an amount not exceeding 10% of the Takaful amount under 1A.

 

1D – Fees and Additional Expenses

The Company will pay, following loss or damage under Section  1A , any expenses or additional costs necessarily  incurred as follows:

  1. With the Company’s consent, in removing debris, dismantling, demolishing, shoring-up or propping of the Residence.
  2. In reinstatement of the Residence to comply with legislation of the Government or other Public Authority.
  3.  For an amount not exceeding 10% of any claim payment in respect of Architects’ Surveyors’, Legal and other fees, in reinstating the Residence.

Exceptions to Section 1D

  1. Costs arising under a notice served by the Government or other Public Authority prior to the loss or damage.
  2. Fees for preparing any claim or estimate of loss.

 

 

1E- Rent and Accommodation

If the Residence is rendered uninhabitable following damage covered under Section 1A the Company will pay, for the period necessary for reinstatement.

Expenses

  1. Loss of rent
  2. The reasonable cost of alternative accommodation.

The total amount payable under this Section is limited to 10% of the Takaful amount under Section 1A.

 

1F – Underground Services

The Company will indemnify the participant against liability for the cost of repairing accidental damage to

  1. Drain covers at the Residence.
  2. Any underground pipe or cable extending from the Residence to the public mains

 

1G – Property Owner Liability

The Company will indemnify the participant as owner of the Residence (and not as householder occupying it) against legal liability for damages (including, where applicable, interest payable) and claimant’s costs and expenses in respect of accidents resulting in bodily injury contracted by any person or loss or damage to property caused by accident during the period of Insurance, limited to BD. 25,000/­ any one accident or series of accidents arising out of any one cause and, in addition expenses agreed by the Company.

Exceptions to Section 1G

  1. For injury contracted by a member of the participant’s household or any person employed by the participant.
  2. For damage to property belonging to or under the control of the participant or a member of the household or a person employed by the participant.
  3. Assumed by agreement unless the liability would have attached in the absence of that agreement.
  4. Arising out of or incidental to the Insured’s profession or business
  5. Arising out of the use of lifts or vehicles.

 

 

 

SECTION 2- CONTENTS

2A – Household Goods Cover

Loss of or damage to the household goods and personal effects belonging to the participant or to members of his household permanently residing with him (or for which he is or they are responsible) and tenant’s fixtures and fittings all in the Residence (which for the purposes of this garages and outbuildings) caused by the Perils specified below.

 

Perils  

  1. Fire, lightning and explosion of domestic vessels only (Fire, excluding self-fermentation and scorching)
  2. Storm (Violent and destructing movement of wind)
  3. Escape of Water (Escape of water from and including damage to fixed tanks, apparatus or pipes)
  4. Burglary (Only if accompanied by violent or forcible entry or exit from the premises)
  5. Impact (Impact by aircraft, aerial devices or articles dropped from them and vehicles not belonging to the participant or his/her family or under his/her control.)

 

Note: No articles of gold, silver or other precious metal, jewellery, fur, curio, picture or other work of art, stamp, coin, medal, or collection of stamps, coins or medals, will be covered if they are of greater value than 5% of the Takaful amount unless described under the schedule under section II.

 

Exceptions to Section 2A

  1. Loss or damage arising under Perils (3) ‘Escape of Water’ and (4) ‘Burglary’ when the Residence has been left unoccupied for a period in excess of 30 days in any Period of Takaful.
  2. Loss of or damage to
  1. The structure, ceilings or decoration
  2. property more specifically insured by this or any other insurance
  3. jewellery, deeds, bonds, securities, documents, cash, stamps of any kind, unless noted specifically by the Company
  4. aircraft.  hovercraft, watercraft, motor vehicles, their accessories, and livestock
  1. Loss or damage under Peril (4) ‘Burglary’
    1. caused by deception
    2. by the Insured or spouse
    3. not involving forcible and violent entry to or exit from the Residence

 

2B – Temporary Removal of Contents

The contents described in the Policy are covered as provided in Section 2A, so far as they are not otherwise insured, whilst temporarily removed within the Kingdom of Bahrain.

Exceptions to Section 2B

  1. Burglary as defined in Peril (4) unless involving forcible and violent entry to or exit from any building or other than in respect of contents temporarily removed.
  1. to any bank, safe deposit or occupied private residence in the course of removal to or from any bank or safe deposit whilst in the charge of the participant or a member of-his/her household.

  1. Property removed for sale or exhibition or to a furniture depository
  2. Loss of or damage to property in transit or on the person caused by storm or flood

 

2C – Miscellaneous Property

The Company will indemnify the participant, as provided in Section 2A and defined in perils, for loss of or damage to garden furniture, including equipment, whilst in the open at the Residence up to a maximum of BD 100/- in any Period of Takaful.

Exceptions to Section 2C

The first BD 5/- of each and every claim.

 

2D- Rent and Accommodation Expenses

If the Residence is rendered uninhabitable following damage covered under Section 2A and defined in perils the Company will pay, for the Period necessary for reinstatement.

  1. Rent for which the participant is liable as tenant.
  2. The reasonable cost of alternative accommodation. The total amount payable under this Section is limited to 10% of the Takaful amount under Section 2A.

 

2E – Personal Accident Benefit

The Company will pay a max. of BD. 10,000/- in aggregate in the event of death or permanent total disability of the participant or his spouse due to external and violent means caused by a personal accident but excluding self-inflected injury and committing suicide as per the continental scale of benefit.

 

2F – Liability as Tenant

The Company will indemnify the participant against legal liability as tenant and not as owner for

  1. Damage to the Residence, garages and outbuildings, landlord’s fixtures and fittings and boundary walls (excluding gates and fences) caused by the Perils defined in Section 2A limited to an amount not exceeding 10% of the sum insured under section 2A.
  2. Accidental breakage of fixed glass forming part of the structure, and sanitary fixtures.
  3. The cost of repairing accidental damage to
    1. Drain covers at the Residence
    2. Any underground pipe or cable extending from the Residence to the public mains.

Exceptions to Section 2F

  1. In respect of item  1 above
    1. ‘Impact’ by falling trees or branches
    2. Frost damage
  2. In respect of item 1 and 2 above, damage whilst the Residence is unoccupied.

 

2G – Legal Liabilities

The Company will indemnify the participant and members of his/her household permanently residing with him/her against their liability for damages (including, where applicable, interest payable) and claimant’s costs and expenses in respect of bodily injury contracted by any person or loss of or damage to property caused by accident during the Period of Insurance, and, in addition, expenses agreed by the Company.

Indemnity is:

  1. Limited in respect of liability for bodily injury including death or disease sustained by any person in the employment of the Insured and arising out of and in the course of the employment.
  2. Limited to BD 25,000/- in respect of other liability caused by any one accident or series of accidents arising out of any one cause.

Exceptions to Section 2G

 Liability:

  1. For injury to or disease contracted by a member of the participant’s family.
  2. For damage to property belonging to or under the control of the participant or a member of his/her househ9ld.
  3. Assumed by agreement unless the liability would have attached in the absence of that agreement.
  4. Arising from the pursuit or exercise of any business, calling, profession or trade by any person entitled to indemnify under this Section.
  5. For loss or ·damage directly or indirectly attributable to the use, ownership or occupation of
    1. aircraft, hovercraft, watercraft, motor vehicles or lifts
    2. animals of a dangerous species and livestock other than horses used for private hacking.
  6. For loss or damage directly or indirectly attributable to the ownership or, except in respect of the Residence, the occupation of land or buildings.

 

 

SECTION 3

Food in a Freezer and/or Refrigerator   

The Company will indemnify the participant, limited to the amount ·specified in the Schedule in any Period of Insurance, against

  1. Deterioration caused by
    1. breakdown of or accidental damage to the freezer and/or refrigerator
    2. fortuitous failure of the public gas or electricity supply (unless due to the deliberate act of the supply authority)
  2. Contamination by fumes escaping from the freezer of food in the participant’s freezer or refrigerator at the Residence provided that the freezer or refrigerator is not more than 10 years old.

 

EXCEPTIONS WHICH APPLY TO THE WHOLE POLICY

  1. Any loss or damage caused by or happening through war, invasion, act of foreign enemy, hostilities (whether war be declared or not), civil war, rebellion, revolution, insurrection or military or usurped power, Riots, Strikes, Civil Commotion, Malicious Damage, Sabotage and Terrorism.

 

    1. Loss or destruction of or damage to any property whatsoever or any loss or expense whatsoever resulting or arising there from or any consequential loss
    2. Any legal liability

Directly or indirectly caused by or contributed to by or arising from

  1. Ionizing radiations or contamination by radioactivity from any nuclear fuel or from any nuclear waste from the combustion of nuclear fuel.
  2. The radioactive toxic explosive or other hazardous properties of any explosive nuclear assembly or nuclear component thereof.
  3. Pressure waves caused by aircraft and other aerial devices travelling at sonic or supersonic speeds.

  1. Any wilful or malicious act by the participant or any member of his/her household.

 

  1. To any electrical, apparatus or part thereof arising from or occasioned by overrunning, excessive pressure, short circuiting, self-heating, arcing or leakage of electricity arising from whatever cause including lightning.

 

  1. Water leakage from a defective roof or pipe.

 

  1. Wear & Tear and gradual deterioration of Insured property.

 

  1. Seepage and pollution.

 

CONDITIONS WHICH APPLY TO THE WHOLE POLICY

  1. The participant will maintain the Takaful amount under each Section of the Schedule at full value.

 

  1. The Takaful policy may be cancelled by the Company at any time giving not less than seven days’ notice by recorded delivery to the participant at the Residence in which event the Company will refund a pro-rata proportion of the contribution (premium).

 

  1. On the happening of any event likely to give rise to a claim under the Policy, the participant shall
    1. Refrain from admitting liability and immediately
      1. Report in writing to the Company
      2. if the loss or damage appears to have been caused by theft, advise the Police
      3. send the Company any writ or summons received.
    2. Co-operate with and not abandon any property to the Company.
    3. Provide all plans, specifications and quantities as the Company may reasonably require if it chooses or becomes bound to reinstate the Buildings.
    4. Do everything required by the Company to obtain indemnity from other parties.

  1. The Company shall be entitled to conduct the defense or settlement of any claim and to instruct a solicitor to act for the participant in any civil or criminal proceedings arising from any event likely to give rise to a claim under the Policy.

 

  1. If the participant shall make any claim under the Policy knowing the claim to be false or fraudulent in any respect, or if he/she or anyone acting on his/her behalf employs any fraudulent means to obtain any benefit under it, this Policy shall become void, and all claims under it shall be forfeited.

 

  1. All differences arising out of this Policy  shall  be  referred  to  the  decision  of  an  Arbitrator  to  be  appointed  in writing by the parties in difference or if they cannot agree upon a single Arbitrator to the decision of two Arbitrators one to be appointed in writing by each of the parties within one calendar month after having been required in writing so to do by either of the parties or  in case the Arbitrators do not agree of an Umpire appointed in writing by the Arbitrators before entering upon the reference. The Umpire shall sit with the Arbitrators and Preside at their meetings and the making of an award shall be a condition precedent to any right of action against the Insurers. If the insurers shall disclaim liability for any claim hereunder and such claim shall not within twelve calendar months from the date of such disclaimer have been referred to the arbitration under the provisions herein contained then the claim shall for all purposes be deemed to have been abandoned and shall not thereafter be recoverable hereunder.

 

  1. Observance of the terms of the Policy relating to anything to be done or complied with the participant or so far as they apply, by any other person entitled to indemnify or benefit under it    and the truth of answers in the proposal shall be conditions precedent to the liability of the Company.

 

  1. Average (underinsurance)

If the property insured; ·at the time. of any DAMAGE, be collectively of greater value than the Takaful amount thereon, the participant shall bear a share of the loss corresponding directly to the proportion of underinsurance. Every item, if more than one, of the policy shall be separately subject to this condition.

 

  1. Contribution

If at the time of any DAMAGE there be any other insurance effected by or on behalf of the participant covering any of the property insured lost, destroyed or damaged, the liability of the Company hereunder shall be limited to its rateable proportion of such DAMAGE.

 

If any such insurance is expressed to cover any of the property insured, but is subject to any provision whereby it is excluded from ranking concurrently with this policy either in who le or in part from contribution rateable to the destruction or damage, the liability of the Company hereunder shall be limited to such proportion of the destruction or damage as the Takaful amount hereby bears to the value of the property.

 

  1. Subrogation

The claimant agrees to subrogate all rights or remedies to the Company for obtaining relief or indemnity from other parties, upon its paying or making good any destruction or damage under this policy, and shall at the request and at the expense of the Company do and concur in doing and permit to be done all such acts and things as may be necessary or reasonably requi•ed by the Company for the purpose of enforcing such rights or remedies, whether such acts and things shall be or become necessary or required before or after his indemnification by the Company.

 

  1. Jurisdiction

The policy applies only to judgements delivered by or obtained from a court of competent Jurisdiction in the Kingdom of Bahrain.

 

  1. Safeguards and Maintenance Warranty Clause

The participant shall all the time take steps to safeguard the property insured and maintain it in a proper state of repair. The participant shall also take steps to enforce the observation of all statutory provisions, manufacturers recommendations and other regulations relating to the safety, use and inspection of the property Insured.

 

  1. Claim Reporting Period

In the event of a claim, the participant should notify the Company within or not less than 14 days after the loss in writing or through facsimile.
